    That's not entirely correct, according to what I heard. What happens when you go to upload a video now it's occasionally subjected to their automated review system. The more times you pass, the less often you're flagged for it and content just goes up right away no problems. As far as LPs go, some companies are just assholes I guess - Ubisoft is not. They put out a very clear statement and laid everything out in black & white terms. They WANT LPers and all this community stuff, they just want us to abide by their conditions when doing so (all of which are reasonable. I don't have the list on me but it'd be nice if more companies would follow Ubisoft's example and that's saying something! o.O )

    As for all the mass flagging/take downs of videos lately? Yeah, that's just garbage for the most part. There are legit videos using unauthorized/pirated content but they're casting a wide net and catching everyone else along with the troublemakers - but then what else is new? :/

      In the whole of human history, not a single advancement in technology was as a result of hoarding patents and keeping away ideas from others. The Persian Empire "copied" the techniques of the Han Dynasty soldiers to increase effective range of their weapons. The Americans took German technology and it eventually gave birth to NASA and the space industry. Artists like Jay-Z sample music from people like M-Flo and Nujabes and don't get sued for it.

      Certain institutions insert themselves between collaboration in the name of "justice" but all they do is undermine progress and introduce greed into the mix. I'm not saying that the creators shouldn't get their just rewards, but at the same time, I believe it to be better if all of humanity benefits from new discoveries and advancements, rather than just a tiny group of elites and power brokers.

        Watched this this morning and a lot of companies are releasing their claims. From what I've heard over the weekend, the usual offenders like Square Enix, Sony and Nintendo are still fucking people over, but surprisingly Sega, Capcom, Bandai and EA aren't screwing over people and are releasing claims.

          It's worth noting that SE, Sony and Nintendo are all hurting financially (Nintendo's going into their 3rd loss in a row, over $300 million USD this time)


          I am a bit surprised at Sony though given all the promotion they've done for things like Twitch and Mark Cerny himself saying we'll be able to directly upload to YT off our PS4s...

            It's mostly SME, which is a completely different entity to SCEJ/SCEA/SCEE. The huge parts of Sony don't talk much to each other. The Nintendo/Microsoft fanboys will scream otherwise but you might as well consider SME and SCEA completely different companies.

            It's also why Sony as a whole tends to post huge losses when it is usually the Film division and TV/Electronics division that tanks and is the money pit. The Gaming and Music parts are doing well. Well doing well considering a new console just got released

              Yeah I'm still a bit surprised that they haven't gutted some of their parts already to stem the bleeding. They haven't been profitable in years...

                There's been rumours for years that they are going to cut Sony Films, it's that big of a money pit. IIRC Sony's TVs are only pulling a profit in the UK. People really like Smart TVs over here XD

                  Uh, Malacite, let's say that we completely abolish copyright and patent law tomorrow. Yes, there will be piracy. And...?

                  There are many, many stores near where I live that specialize in selling pirated media. In fact, it used to be even worse; you could easily get copies of pirated cartridge games back in the day, because the video game stores would simply rewrite the cart for you for a nominal fee. These days, it's mostly movies. And yet the official copies still sell.

                  There are numerous stores across Asia that specialize in selling reproductions of luxury items. I've seen huge volumes on how to distinguish legitimate and counterfeit LV bags. Yes, there is a certain subset of the population that will buy the counterfeit item, and yet the luxury item still sells far better than it has any business doing.

                  I think for most media, piracy in the modern age is a given, not a possibility. The same goes for pretty much any desirable consumer item. Even drugs are being pirated nowadays. And yet all of these industries persist, and thrive even more today than they did in the past. Copyright, at this point, seems to be doing more to limit creativity than to enhance it. The same goes for patents. Trademarks, I don't think anyone has a problem with, but even though, an accurate reproduction including a logo, I couldn't really care less about, as long as it is made clear at the point of sale that it's inauthentic. If you have a problem with that, well, reducing the penalties on the first two would also reduce the need to fake the third.

                  Also, these are videos of games on youtube. Even assuming the video was ONLY cutscenes, without any original content -- does anyone really believe that there are significant numbers of people out there buying games purely for the cutscenes, who would replace that by watching the videos online if given the option? I think most of us would agree that that would be the sign of a very, very bad game; if companies are being hurt by people leaving their games to watch youtube videos, I think that says a helluva lot more about the games they're making than anything else. And if I don't need the interactive aspect to enjoy the game, why on earth should I shell out the hundreds of dollars that console equipment (let alone PC) costs? Why can't that content simply be made available on DVD/BD/iTunes, etc.?

                      Yes, they don't explicitly spell it out, but two things worth noting; one, the grey market they talk about is huge, thanks to western firms leaving their designs with Chinese companies. One of the reasons Taiwan, Korea and other nations still have thriving high tech industries is that companies don't trust the Chinese to steal their brand new technology. Designs intrusted to Chinese companies have a way of finding their way into other factories with remarkably similar owners; apart from simply having units made above what's reported to the company they're being manufactured for, there are factories devoted simply to turning out products they were never asked to make.

                      Two, as for those stores I mentioned above, they alluded to it in the video when they mentioned Shenzhen. Shenzhen is situated immediately to the north of Hong Kong, on the other side of the border. This makes it a popular destination for both HK residents and traveling foreigners, who cross the border to save money. They have an entire mall which is famous for its replica/counterfeit goods shops.

                      tl;dr if you do business in China, there is a very good chance that the money you save in production is partially being offset by profits you're not making.
