The fact is, it's not a crime to be a dick. It is a crime to strike another person. She didn't have the granddaughter's consent clearly, and she didn't have a reason to believe it was in self-defense. That's just plain battery. Doesn't matter if it's your granddaughter, a shop assistant, a random guy on the street, your spouse-- if you slap someone, you're commiting a crime. Doesn't matter how rude, inconsiderate, troublesome, or dickish they're being.

make judgment calls all the time and don't arrest offending parties frequently.

I'm going to say this one more time and I'll use small words because you don't seem to be able to understand anything else.

They do not always have the right to choose how to apply the law.

Grandma hit an adult member of her family. That is domestic assault. The police were called. The law in the area says that they must arrest the perpetrator. They are not to make a judgment call. That is the purview of the judge later.

I'll almost bet you 2 gil this took place in Florida. Have you ever been harrassed by the cops there?

I concur with the previous poster that the cops "did not" have to do their job in this one. Cops make judgment calls all the time. These particular cops were just being too cerebral and to the letter. Laws are not made to brow beat someone with that is clearly in the right, due to technacalities; though the world would have one think differently. Unfortunately for Gramma, she got stuck with some idiot cops.

If someone mentions this took place in a southern state or California, then I'll concede my point and let others win.

I agree.. I got jumped once, and the cops came, and didn't arrest the dudes that jumped me.. Why? I dunno.

I mean it would be one thing if granny had repeatedly hit the youngster, but a single, disciplinary slap in the face? Hardly constitutes assault to me, but I don't make nor enforce the laws.

Mhurron's technically right in that the Cops acted accordingly to protocal, but it still just feels asinine. This whole incident reeks of stupidity in the law, like how a burglar can actually sue (and WIN!!! orz) a homeowner if they get injured on their property, even during the burglary. That's real freaking cute.

Dispensary slap does not equal "hit" or "assault" you can quote the law all you want, but all that does is show that you have no real argument.

No one can deny that when the see a kid acting like a brat or being disrespectful, they don't think in the back of their head "god I wish someone would smack em" I am just more vocal about it.

This is a perfect example of what happens when a parent does not discipline their child properly or unreliably, they turn into little disrespectful twits, like the girl in this story.

The cops arresting the Grandmother, just show that the cops in this case, where either stupid, or they believed the young cute boobs more then the poor old lady.

Generally when I think of discipline, it's 'removal of privileges' rather than 'someone smack em'.

Edit: And this is coming from someone who DID get a heafty smack on the arse when he was being a little shit.

Edit2: On topic, I think it's lame that the daughter doesn't seem to be legally accountable for assaulting her grandmother, but at least she's getting punished by the grandparents now.
