    "Thompson sues Florida Bar
    Antigame activist lawyer sues state's legal regulatory association, saying they conspired against his rights as a citizen.
    Jack Thompson is in court again after being tossed off an Alabama civil-court case against game-industry players, including the makers of Grand Theft Auto, but this time he's representing himself. Earlier this week, Thompson filed suit against the Florida Bar, of which he is a member, claiming the regulatory association has been conspiring against his rights as a citizen.

    The North Country Gazette Web site is reporting that Thompson believes the Bar has been collaborating with opposing lawyers in his lawsuits over Grand Theft Auto and Howard Stern, encouraging them to file Strategic Litigation Against Public Participation (SLAPP) complaints against him for over a year and a half. In common legal lingo, a SLAPP complaint is a lawsuit that creates a chilling effect on free speech--it is intended solely to discourage a party from expressing a certain point of view by intimidation and the burden of legal costs associated with defending oneself against the complaint.

    This is not the first time Thompson has sued the Florida Bar. He sued the group under the Civil Rights Act in 1990, but his complaint was dismissed with prejudice the next year. The case dragged into 1993 as the Florida Bar attempted to have a judge impose sanctions on Thompson, but their efforts fell short. The North Country Gazette reports that Thompson's complaint references his history with the Bar.

    "In the early 1990s, for example, The Florida Bar, in league with pornographers and their attorneys, as well as with an operative of the American Civil Liberties Union, persuaded the Florida Supreme Court, ex parte, to enter an order mandating that Thompson must submit, without protest, to psychiatric and psychological tests administered by health care providers chosen by The Bar because of 'Thompson's alleged obsession against pornography which is so severe that he is disabled by that obsession and thus unfit to practice law,'" his complaint reads. "'Brain damage' was also alleged...The Bar's experts found that Thompson was suffering neither from brain damage nor from any mental illness, and that he was in fact simply pursuing his activist Christian faith in the public and legal arenas."

    Thompson's complaint then says the Bar was made to pay him monetary damages as a result of the charges.

                Thompson Files Suit Against Florida Bar Association

                So sue me.

                Collectively, that's what the Florida Bar Association said to our old pal Jack Thompson, who was only too glad to oblige. As reported by the Daily Business Review, the controversial Miami attorney has filed a $1,000,000 federal lawsuit against the Florida Bar, alleging that the organization is harassing him by investigating what Thompson contends are baseless complaints filed by a pair of rival law firms.

                "I enjoy doing what I do and I think I've got a First Amendment right to annoy people and participate in the public square in the cultural war," Thompson told the newspaper.

                GP: We're glad someone enjoys what Jack does, but we've re-read the First Amendment umpteen times and still can't find the "right to annoy people."

                As previously reported by GamePolitics, Thompson faces bar complaints stemming from his dealings with Philadelphia law firm Blank Rome in the Alabama GTA cop killer case, Strickland vs. Sony; from allegations about his professional conduct in his campaign against shock jock Howard Stern; and from the Alabama judiciary, which revoked his pro hac vice (visiting) bar admission last November.

                While the Florida Bar is apparently still digesting Thompson's complaint, the organization's president Alan Bookman said, "We're very comfortable with everything that the Bar has done. Everything the Bar has done has been appropriate and proper."

                The specifics of Thompson's complaint involve allegations made by attorney Lawrence Kellogg of Tew Cardenas, outside counsel to a Naples, Florida-based broadcast group which previously aired the Stern program. GP and other media outlets have been cc'd on frequent, highly volatile e-mails from Thompson in which he questions the integrity of Tew Cardenas attorneys.

                Kellogg declined to discuss his bar complaints against Thompson, saying only, "I was justified in filing my Bar complaint against Mr. Thompson and The Florida Bar Grievance Committee has found probable cause that he violated Bar rules. I'm now leaving it in the hands of The Florida Bar."

                Nor did Blank Rome have much to say.

                "Because proceedings are ongoing, we are not able to comment," spokesman Topper Ray told the Daily Business Review. According to the paper, Thompson asked the U.S. Department of Justice to investigate the Bar's actions in regard to complaints filed against him.

                "The Florida Bar and its agents have engaged in a documented pattern of this illegal activity, which may sink to the level of criminal racketeering activity, in a knowing and illegal effort to chill my federal First Amendment rights," Thompson wrote at the time to Alex Acosta, acting U.S. Attorney for the Southern District of Florida. Acosta's office forwarded the letter to the FBI in Miami for review.

                GP: We note Thompson's strategic use of the word "may," as in "...may sink to the level of criminal racketeering activity..." Yes, and GP's long-awaited night on the town with Jennifer Anniston may happen this weekend.

                The bombastic, anti-game attorney told the paper he has a good feeling about his lawsuit.

                "I'm 100 percent certain that it will effect change, otherwise I would not have filed it," he said. Thompson also owns and operates www.theflabar.org, a rudimentary, rarely updated website which bills itself as "...the site to get the REAL Florida Bar to protect the public rather than its narrow agenda."

                We should note that Thompson's 2005 book describes an early 90's episode in which he sued the Florida Bar and collected a $20,000 settlement after the Bar forced him to undergo psychiatric testing. He passed, by the way.

                Hey, you can't make this stuff up.

                  He reminds me of someone in the Uk, a female who didn't want a single peice of flesh to be shown ont h screen and demanded everythign was sensored that could cause even the slightest misconception or act of difference in the society. She won some, but failed missery at otehrs. granted much of it was about pornography etc. but he did campaign against violent films, the mini skirt when it was introduced in the 60's and any women showing any flesh other thn the hands and face. a very old fashioned witch as she was knwon by many. her name was Mary Whitehouse.

                  Many people think u brits are bland, beige and boring. if she got her way 100% we'd be even worse!!!!

                  Give me the Dutch influence any day, where censorship is up to the individual. now thats what i call freedom of decission.

                    I had been hoping Jack would go away for a while. The man is a loose cannon and I expect him to have a much harder time this time.

                        lol No, the bar association is like a union of lawyers. You have to be certified to practice law by the state bar association before you can open a legal practice.

                            Yeah, but ... maybe better the devil we know than the one we don't? Jack Thompson is a farce. If he's removed from the media spotlight rallying against video games, who might take his place?

                            Jack is not special. He is not a unique snow flake as they say. He is just the latest vocal opponent of whatever is "corrupting" our youth at the moment. When my dad was growing up it was rock and roll devil music. Then it was comic books then movies and rap music. Today it’s videogames. If we were to succeed in getting Jack blacklisted from the major news outlets someone else would simply take his place. Imagine him as an actor playing a part in a play. The point is that Jack Thompson is not important. If he were to be fired a new actor would simply take up the role. The same lines would still be delivered in the same way and the same audience would pay to see it. We are actually fortunate that the current actor is so impotent in his role. Imagine what might happen if some charming, efficacious attorney took his place. The more I consider it the more I think we may be lucky to have Jack playing the part of the alarmist. The alternative might be someone who is actually capable.

                              I agree. Much as I dislike everything that Jack Thomspon espouses, his net effect on the industry is effectively zero since he's simply so... ridiculous. Much better an ineffectual attention whore than someone who might actually get something done.

                              Besides, as long as he's pestering the Florida Bar, he'll have his hands full defending his case and not bothering the people in the industry, who have quite enough problems of their own as is.

                              I'm still rooting for the Florida Bar though.
