Is it possible to change your in-game skin tone darker? If so, would you get in trouble for it?

Well if you are doing the PC version it is possible, as for getting in trouble that would only depended on how severe SE decides to go. The way the games design character appearance is all client side, any change you make to it occurs to everyone of that same model type. Again though since it's client side it's only visible to you on what has changed, to everyone else you'll still appear as the original SE default design.
The only reason I could see SE possibly complaining is if by some strange reason the change drastically modifies the character models load time and if that load time was to cause any implication to the servers normal operation (Which I think is unlikely).
Outside of that if you are say a Hume Male Face 1A and you change it's tone then every Hume Male Face 1A you see will have that same change, again only visible to you.

In the end, no one would know but you, since the changes made would only apply to your client. However, don't do anything of the sort unless you know what you're doing; it can be very harmful to your installation when done incorrectly.

Just so you know, if you do intend to drastically change the skin tone of your character(Say from dark tan to chalk white or something) you will have to edit *EVERY* piece of armor that you can wear that shows skin. If you just change the color of your character's face, then equip a bronze harness or something, the skin tone on the harness will not match the skin tone of your face. Also, changing the color of each armor will mean that every other character of the same race and gender as you who wears that armor will have the same changes.
Skin tone is not in and of it's self one file. It is built into each and every unique .dat file for armor in the game. That is the reason why every character for a specific race and gender will have the same exact skin tone.
So yes, it can be done, but it will be a *very* difficult project to do.
