Although they did edit the ToS to include things such as getting screwed in the game by another player in items and/or gil, I don't believe they give the items back to their rightful owner when the issue is settled completely. All that they mention is that the items in question will be confiscated by a GM along with any other items that are associated (such as items bought with stolen gil) and the player that has comitted the wrong-doing will be sent to GM Jail and eventually suspended upon further instances of this.

That will provide a much larger combination of possibilities that Brute Force hacks can't do. Either way though Brute Force hacking is a pretty old concept and not to commonly used anymore because of the quantity of possible combinations and time it takes to break them.
Besides that why bother forcing your way in when you get the person to give you access to it. Therefore, if you got hacked it is definitely not brute forcing/guessing of passwords because the person must know your login ID as well. Which is why..
1) never give away your account details unless you trust that person (sometimes even trusted friends can easily betray your trust because Gil/Rare items > Friendship)
2) keyloggers (because you download a 3rd party program that is FFXI related or somebody in FFXI sent it to you intentionally). I say this because how would any other person know that the logged ID and passwords is for FFXI unless they play it themselves.
Most mmorpg companies don't give a shit if your account got hacked because they get so many reports of such incidents everyday, it is impossible (well... not impossible just time consuming and they're lazy) to investigate and sort out all of them.
